F.O.I. Act

On 1st November 2002, Regulations were signed into law providing for the extension of the Freedom of Information (FOI) Act to the N.D.P./C.S.F. Information, Evaluation and IT Units.

The Act establishes three statutory rights -

  • A right for each person to access information held by public bodies.
  • A right for each person to have official information relating to himself/herself amended where it is incomplete, incorrect or misleading.
  • A right to obtain reasons for decisions affecting oneself.

The FOI Act allows public access to information held by the N.D.P./C.S.F. Information, Evaluation and IT Units, to the greatest extent possible consistent with the public interest and the right to privacy. The Act covers information that is not routinely available through other sources. Access to information under the Act is subject to certain exemptions and involves specific procedures and time limits.

A reference manual has been prepared and published in accordance with the requirements of Sections 15 and 16 of the Act. It outlines the structure and functions of the N.D.P./C.S.F. Information, Evaluation and IT Units, the services they provides and how they apply them, the classes of records held and guidelines on how to make a request for information under the Freedom of Information Act, 1997.
